Terms & Conditions of Sale

General

By placing an order, you are agreeing to purchase a digital product and be subject to the following terms and conditions. All orders are subject to availability and confirmation of the order price.

Payment Options 

All payments are made through the Shopify Pay payment system.  

Delivery Methods & Times 

All products sold on this website are digital and will be delivered via email to the inbox associated with your order. 

Orders are typically processed immediately upon payment confirmation and should be received within 24 hours. If you have not received your digital product within this timeframe, please check your spam or junk folder and contact us if necessary. 

No physical delivery or shipping applies to digital products purchased through this website.

Cancellation & Returns Policy 

We hope you will be completely satisfied with any product purchased from us. However, if you would like to withdraw from the purchase of your digital product you can do so by requesting a return within 14 days of purchase once you have not downloaded or begun using the product/service.

Refunds of downloaded products or after commencement of a digital course may be granted under the following circumstances:

  • The digital product is faulty or not as described
  • The product was not delivered or accessible after purchase.

If you believe you qualify for a refund, contact us at education@dogstrust.ie with your order details and a description of the issue. 

We cannot issue refunds for: 

  • Change of mind once the digital product is downloaded or accessed.
  • User error

Refunds 

All refunds will be processed in accordance with our returns policy. 

Return requests will be checked by a member of our team and if applicable, an email will be sent confirming the refund. 

After you have received the refund email, please allow 7—10 business days for the refund to be credited to your account.

Intellectual Property 

All digital products and materials provided through this website remain the intellectual property of Dogs Trust Ireland. By purchasing and accessing the materials, you are granted a non-exclusive, non-transferable licence for personal use only. 

You may not: 

Copy (other than to download any materials we make available to you), distribute, modify, or share the content in any form, whether digitally or physically. 
Use the content for commercial purposes or for the training of others without prior written consent from Dogs Trust Ireland. 
Claim ownership of any content provided through this website. 
Any unauthorised use of the materials constitutes a violation of copyright law and will be pursued to the fullest extent permitted by law.

Orders 

All goods featured on this website constitute an “invitation to treat” and not a formal offer by Dogs Trust. The following are the technical steps required to create a contract to purchase goods via this website: 

  1. You place an order on the website by selecting an item and following the instructions on the website and finally by clicking on the "make payment" button at checkout. You will be able to identify and correct any input errors prior to clicking the "make payment" button.
  2. You will receive an "order confirmation" email from us setting out the goods you have ordered and the price including all applicable taxes. This is a confirmation of an order and does not constitute a binding contract between us.
  3. Once the payment has been authorised, we will process your order and send you a confirmation email with access to the digital product(s). At this point, a binding contract between us is formed.
  4. You should retain all emails relating to the order and contract for future reference.

Stock Levels 

As all products are digital, availability is not typically constrained. However, in rare cases of system outages or maintenance, temporary delays may occur.

Our Liability

Our liability for any losses you suffer howsoever arising in relation to these Terms and Conditions of Sale is strictly limited to the purchase price of the product(s) you purchased.

This does not include or limit in any way our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any matter for which we cannot exclude or limit our liability under applicable law.

We are not responsible for indirect losses, including but not limited to: (a) loss of income or revenue; (b) loss of business; (c) loss of profits or contracts; (d) loss of anticipated savings; or (e) loss of data; however arising and whether caused by tort (including negligence), breach of contract or otherwise.

Written Communications 

Applicable laws require that some of the information or communications we send to you should be in writing. When using our website, you accept that communication with us will be mainly electronic. We will contact you by e-mail or provide you with information by posting notices on our website. You agree to this electronic means of communication and you acknowledge that all contracts, notices, information and other communications that we provide to you electronically comply with any legal requirement that such communications be in writing. This condition does not affect your statutory rights.

Data Protection

Your data, as well as information you may provide during your use of the website, is subject to our Privacy Statement, which is incorporated by reference into these Terms and Conditions of Sale.

Unforeseen Circumstances

While every effort will be made to meet your demands, cancellations or variations may be necessary as a result of an act of God, war, strike, lockout, labour dispute, fire, flood, drought, or other causes beyond our reasonable control (Force Majeure Event). We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under a contract with you that is caused by a Force Majeure Event. 

Our performance under any contract is deemed to be suspended for the duration of the Force Majeure Event, and we will have an extension of time for performance for the duration of that period.

Indemnity

You agree to indemnify, defend and hold harmless Dogs Trust's directors, officers, employees, consultants, agents, and affiliates, from any and all third party claims, liability, damages and/or costs (including, but not limited to, legal fees) arising from your breach of these Terms and Conditions of Sale.

Invalidity

If any part of the Terms and Conditions of Sale is unenforceable (including any provision in which we exclude our liability to you) the enforceability of any other part of the Terms and Conditions of Sale will not be affected and all other clauses shall remain in full force and effect. So far as possible where any clause/sub-clause or part of a clause/sub-clause can be severed to render the remaining part valid, the clause shall be interpreted accordingly. Alternatively, you agree that the clause shall be rectified and interpreted in such a way that closely resembles the original meaning of the clause /sub-clause as is permitted by law.

Complaints

We operate a complaints handling procedure which we will use to try to resolve disputes when they first arise. Please let us know if you have any complaints or comments by contacting us immediately by fax, phone or e-mail (for details see the Contact section at the end of these Terms and Conditions of Sale).

Governing Law and Jurisdiction 

These Terms and Conditions of Sale are governed by the laws of Ireland. Any disputes or claims arising from these terms will be subject to the exclusive jurisdiction of the Irish courts.

Entire Agreement 

41.The above Terms and Conditions of Sale constitute the entire agreement of the parties in respect of the subject matter hereof and supersede any and all preceding and contemporaneous agreements between you and this business.

The materials are provided for information purposes only and they should not be relied on as formal advice for your specific circumstances. To the extent permitted by law, Dog Trust Ireland accepts no liability for any loss or damage caused as a result of your reliance on it.
